Horner Law Group’s real estate litigation team is experienced in the areas of purchase and sale litigation, mechanic’s lien litigation, construction litigation, easement litigation, and general real estate matters such as covenants, conditions and restrictions, and general property rights. Our attorneys are very well versed in construction litigation, including mechanic’s lien litigation. We regularly represent owners, sellers, landlords, tenants, brokers, general contractors, subcontractors, and design professionals in litigation.
For example, in 2010, Mr. Horner was retained by a purchaser of an industrial special use manufacturing facility to represent it with respect to a dispute arising from the purchase of the facility. The case included both the seller and the brokers as defendants and involved disclosure and fraud issues. While the case was settled against the brokers, the 3-week jury trial against the sellers resulted in a 12-0 verdict on all counts and a judgment of almost $3,000,000 in favor of Mr. Horners client. The litigators of Horner Law Group also know that obtaining a judgment is only the first step – our team is also skilled at turning judgments into real money through the collection and enforcement of those judgments. The litigation team was successful in collecting the entire amount owed under the above-referenced judgment.
In 2013, Mr. Horner successfully defended a $3.2 million claim against a national commercial brokerage. Mr. Horner was able to successfully challenge the pleadings and have the court dismiss the case in its infancy pleading stages. His client was then awarded its costs incurred in the action. Our litigation team also recently successfully represented a fortune 500 tenant in mechanic’s lien litigation with its general contractor and numerous subcontractors.
